The Family Green Card Program is one that allows U.S. citizens and lawful permanent residents (green card holders) to sponsor their family members for permanent residency. This program is designed to reunite families and keep them together in the United States. Immediate relatives of U.S. citizens, such as spouses, parents, and unmarried children under the age of 21, are eligible for a green card without having to wait for a visa to become available. Other family members, such as siblings and married children, may also be eligible, but may have to wait for a visa to become available due to visa quotas.
Our client came to us looking for information on filing for his green card. He entered the country illegally and needed a waiver. He needed to apply for an I-601a waiver (Application for Waiver on Grounds of Inadmissibility) and needed assistance to be eligible for a provisional waiver of the unlawful presence ground of inadmissibility. During his interview back home in Honduras, new information was brought up, which ended up resulting in his waiver getting denied and him staying there for three years. Our firm ended up refiling his waiver again, however, COVID came along and processing times for these applications were moving slower. Our client at this point cannot leave Honduras. His wife and kids would not be able to move to Honduras as it would be an extreme hardship for them. We explained that the security and health of Honduras were a major concern for U.S. citizens there, as the country lacked the resources needed by law enforcement to address the ongoing criminal activity there. Having our client, nonetheless having his family in Honduras would put his family, their future, health, and security at great risk.
Our client’s wife was struggling emotionally and financially to support their children. She was not prepared for the financial hardship about to hit them, no one could have prepared them for that. Her husband was the only source of income for their family. They had three children all under 12 years of age, and the youngest was four years old. Our client’s wife and kids were all undergoing extreme psychological and emotional trauma from not having their father/husband there with them.
The children were experiencing difficult times with their education, handling their emotions, and sleeping at night. They didn’t know when their dad would come home, and could not visit him as it wasn’t safe to visit, nor could they afford to do so. We ended up refiling his Immigrant Visa and Alien Registration. The RFE response was sent out in February of 2020.
Eventually, our client’s second waiver gets approved and he gets scheduled for an interview! (By March of 2020 his I-601 was approved!) Shortly after he got his passport to travel back to the U.S. and was reunited with his family after three years of being apart.
